Abell Rose Law Settles Class Action with The UPS Store® locations in Kentucky

After six years of litigation, The UPS Store, Inc. and Kentucky franchisees that operate over 30 stores in Kentucky have agreed to settle claims brought by a former customer on behalf of herself and others in which she alleged excessive and unlawful charges of 10-20 times the allowable rate for notary services under Kentucky law. Judge Angela McCormick Bisig, presiding judge in Jefferson Circuit Court, granted preliminary approval of the settlement of the case on February 10, 2021, at the request of attorneys at Abell Rose Law in Louisville, who filed and prosecuted the case for the customer and the class. The preliminary approval of the settlement paves the way for anyone who purchased notary services from a Kentucky “The UPS Store” location between February 12, 2010, and July 15, 2016, to participate in the class action settlement by filing a claim between March 5, 2021, and May 11, 2021 (PDT). Eligible class members may receive a store voucher of $10 – $20 to be redeemed at participating locations of The UPS Store in Kentucky, with some limited exceptions.

What Is This Settlement About?
Entitles that operate over 30 The UPS Store ® Franchises in the State of Kentucky, as well as their franchisor, The UPS Store, Inc., have agreed to fully settle and release claims of all who purchased notary services at the
Franchisees between February 12, 2010, and July 15, 2016. Each voucher is redeemable for between $10.00 – $20.00 for a one-time use.

Who Is Eligible to Receive a Class Voucher?
To receive a Class Voucher, a Class Member must (1) provide the Class Member’s name, address, e-mail address and telephone number; (2) certify under penalty of perjury that he or she paid more than $0.50 for notary services at a The UPS Store operated by one of the Franchisee Defendants, JZJ, or Forty One Adventures during the Class Period, and (3) state whether he or she paid more than $0.50 for notary services at a The UPS Store operated by one of the Franchisee Defendants, JZJ, Inc. or Forty One Adventures, Inc. during the Class Period on one, or more
than one occasion  If a Class Member certifies he or she was charged more than $0.50 for notary services on more than one occasion during the Class Period, that Class Member may claim a maximum of two Class Vouchers.

How Do You File A Claim?
To be eligible to receive a Class Voucher, you must complete and submit a valid Claim Form between March 5, 2021, and midnight on May 11, 2021 (PDT). You may submit your Claim Form online or download a Claim Form by visiting TheUPSStoreNotarySettlement.com. To be valid, a Claim Form must be completed fully and accurately, signed under penalty of perjury, in accordance with all terms and conditions, and timely submitted.
